BorderMatch Terms of Service

Welcome to BorderMatch ("BorderMatch", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our websites, applications, and services (collectively, the "Service"). BorderMatch is a transit search and information platform that helps users find and compare public transit and shuttle options for cross-border travel between Windsor, Ontario and the Detroit, Michigan area, including Detroit Metropolitan Wayne County Airport (DTW). By accessing or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1) What BorderMatch Is (and Isn't)
- Transit search aggregator. BorderMatch aggregates publicly available transit schedules, fares, and route options from third-party transit operators (such as The Linq, DAX, SMART FAST Michigan, and others) to help users plan cross-border travel between Windsor, Ontario and the Detroit, Michigan area, including DTW.
- Not a transportation provider. We do not operate vehicles, sell tickets, provide transportation, or act as a carrier, broker, agent, or insurer. All transportation is provided solely by independent third-party transit operators.
- No direct booking or payments. BorderMatch does not process bookings or payments for transit services. "Book Now" buttons and similar links redirect you to the transit operator's own external website, where you book and pay directly with that operator.
- Informational only. All schedules, fares, route information, travel times, and availability displayed on BorderMatch are sourced from third parties and provided for informational purposes only.
2) Key Definitions
- Service: the BorderMatch website, applications, and transit search tools.
- User / You: any person who accesses or uses the Service.
- Transit Operator: a third-party transportation company whose schedules, fares, and booking links are displayed on the Service (e.g., The Linq, DAX, SMART FAST Michigan).
- Search Results: the transit itineraries, schedules, fares, and routing information displayed to Users by the Service.
- Booking Link: a hyperlink on the Service that redirects Users to a Transit Operator's external website for ticket purchase or reservation.
3) Use of the Service
- You must be 18 years of age or older to use the Service.
- An account may be required for certain features of the Service. If you create an account, you must provide accurate information and keep your credentials secure.
- You agree to use the Service only for its intended purpose: searching for and comparing transit options.
- You are responsible for verifying transit information (schedules, fares, availability) directly with the Transit Operator before traveling.
4) Third-Party Transit Operators and Booking
- No agency or partnership. BorderMatch has no contractual, agency, or partnership relationship with Transit Operators unless expressly stated. Display of an operator's schedules or fares does not imply endorsement.
- External bookings. When you click a Booking Link, you leave the BorderMatch platform and enter the Transit Operator's website. All subsequent interactions — including booking, payment, refunds, cancellations, and customer service — are between you and the Transit Operator, governed by that operator's own terms and conditions.
- No responsibility for operators. BorderMatch is not responsible for the acts, omissions, services, pricing, refund policies, or customer service of any Transit Operator.
- Affiliate compensation. BorderMatch may receive compensation from Transit Operators when Users click Booking Links or complete bookings. This does not affect the information displayed or the price you pay.
5) Accuracy of Information; No Guarantees
- Third-party data. Schedules, fares, travel times, stop locations, and availability are sourced from third-party Transit Operators and public data sources. BorderMatch does not guarantee the accuracy, completeness, timeliness, or reliability of this information.
- Changes without notice. Transit Operators may change schedules, fares, routes, or service availability at any time without notice to BorderMatch or its Users.
- Currency conversion. Fares may be displayed in Canadian Dollars (CAD), US Dollars (USD), or other currencies. Currency conversions are approximate and may not reflect the exchange rate applied by the Transit Operator at the time of booking. You should confirm the final price on the operator's website.
- Service availability. BorderMatch does not guarantee uninterrupted access to the Service or that Search Results will be available for all dates, routes, or operators.
6) Border Crossing and Travel Compliance
- Routes displayed on the Service may involve crossing the Canada–United States international border.
- You are solely responsible for understanding and complying with all applicable laws and regulations, including immigration, customs (CBP/CBSA), passport and visa requirements, and any other entry requirements.
- BorderMatch does not guarantee admission at any border crossing and is not responsible for delays, secondary inspection, refusal of entry, or any other consequences related to border crossing.
- BorderMatch does not provide legal, immigration, or travel compliance advice.
7) Prohibited Uses
When using the Service, you agree not to:
- Scrape, crawl, reproduce, or systematically download data from the Service without prior written consent.
- Use the Service for any unlawful purpose or to solicit or promote illegal activity.
- Interfere with or disrupt the Service's operation, including by introducing malware or performing denial-of-service actions.
- Attempt to bypass access controls, security measures, or rate limits.
- Misrepresent your identity or affiliation when using the Service.
- Use the Service to develop a competing product or service.
BorderMatch may restrict or terminate access for violations of these rules.
8) Intellectual Property
The Service, its design, software, and content (excluding third-party Transit Operator content) are owned by BorderMatch or its licensors and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works except as expressly permitted. Transit Operator names, logos, and trademarks displayed on the Service belong to their respective owners and are used for informational purposes.
9) Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge and agree to the collection and use of information as described in the Privacy Policy.
When you click a Booking Link and visit a Transit Operator's website, that operator's own privacy policy applies to any information you provide to them.
10) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." BORDERMATCH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SEARCH RESULTS, SCHEDULES, FARES, TRAVEL TIMES, OR AVAILABILITY WILL BE ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS. BORDERMATCH DOES NOT CONTROL TRANSIT OPERATORS, THEIR SERVICES, VEHICLES, SCHEDULES, OR FARES, AND IS NOT RESPONSIBLE FOR THEIR ACTS OR OMISSIONS. CURRENCY CONVERSIONS ARE APPROXIMATE AND MAY NOT REFLECT ACTUAL EXCHANGE RATES AT THE TIME OF BOOKING.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BORDERMATCH, ITS AFFILIATES, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF DATA; PERSONAL INJURY; PROPERTY DAMAGE; OR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE, THIRD-PARTY TRANSIT SERVICES, OR ANY BOOKING MADE THROUGH A TRANSIT OPERATOR—WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY—EVEN IF ADVISED OF THE POSSIBILITY.
Our aggregate liability for all claims shall not exceed CAD $100.
Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.
12) Indemnification
You agree to defend, indemnify, and hold harmless BorderMatch and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms or applicable law; (c) your travel arrangements, bookings, or interactions with Transit Operators; or (d) your border crossing, travel documents, or compliance with immigration or customs regulations.
13) General Provisions
Changes to the Service or Terms. We may modify the Service or these Terms at any time. Material changes will be posted with an updated "Effective date." Continued use after changes means you accept the new Terms.
Suspension and Termination. We may suspend or terminate access to the Service at any time for any reason, including violations of these Terms. Certain provisions survive termination (including Sections 10–13).
Governing Law and Dispute Resolution. These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of laws principles. You consent to the exclusive jurisdiction and venue of the courts located in Ontario for any dispute. You and BorderMatch will first attempt to resolve disputes informally in good faith for 30 days before filing suit.

If any provision of these Terms is found unenforceable, the remainder stays in effect. Failure to enforce is not a waiver. These Terms constitute the entire agreement between you and BorderMatch regarding the Service.
