BorderMatch Terms of Service
Effective date: October 2, 2025
Welcome to BorderMatch ("BorderMatch", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our websites, applications, and services (collectively, the "Service"). By creating an account, posting a ride request, making an offer, paying a matching fee, or otherwise using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1) What BorderMatch Is (and Isn't)
- Matching platform only. BorderMatch is a peer-to-peer matching service, similar to a dating app. We only exchange contact details between people with similar interests in cross-border travel (e.g., Windsor ↔ Detroit).
- No transportation, no marketplace. We do not operate vehicles, arrange or provide transportation, act as a carrier, broker, agent, insurer, employer, or organizer, or guarantee that any trip will occur.
- No in-app communications. We do not facilitate or monitor communications between members. Once a match is made and the matching fee (if any) is paid, contact details are exchanged and members coordinate directly.
- No ride payments. We do not handle, process, escrow, collect, or guarantee any compensation between members. All ride payments are handled in person between Rider and Driver.
2) Key Definitions
- Member: a registered user of the Service.
- Rider / Driver: a Member seeking a ride / offering a seat.
- Match: the exchange of contact details between specific Rider(s) and Driver(s).
- Matching Fee: the nominal fee BorderMatch may charge to enable contact exchange (not a fare).
- Suggested Compensation: an informational amount shown to Members based on self-reported data; not a quote, not binding, and not guaranteed.
3) Eligibility & Accounts
- You must be 18+ and have legal capacity to agree to these Terms.
- Create one account per person and keep your credentials secure.
- You must provide accurate, current, and complete information.
- Self-reported info only. BorderMatch does not perform background checks, document verification, driving record checks, or identity validation. You are solely responsible for verifying the other party to your satisfaction.
4) Privacy & Contact Sharing Consent
- By requesting a ride as a Rider or making an offer as a Driver, you expressly consent to share your personal information (including but not limited to name, date of birth, gender, email, and phone number) with the other party to facilitate direct coordination.
- We do not monitor or control subsequent communications between matched Members.
- See our Privacy Policy for how we collect, use, and store data and for cross-border data transfers.
5) Fees, Payments & Refunds
- Matching Fee. We may charge a nominal fee to unlock the contact exchange for a given match. This fee is for our matching function only; it is not a transportation fare.
- No compensation handling. BorderMatch does not collect or remit any amounts between Riders and Drivers for rides.
- Refunds. Once contact details are released to either party, the Matching Fee is generally non-refundable, except where required by law or at our discretion for technical errors.
6) Suggested Compensation
Any "Suggested Compensation" we display is informational only, derived from self-reported inputs (e.g., route, timing, risk profile). It is not guaranteed, may be inaccurate, and is not an offer, quote, or commitment by BorderMatch or any Member.
7) No Guarantee of Rides or Outcomes
BorderMatch does not guarantee that a Rider will receive offers, that a Driver will receive Riders, that a match will occur, that a matched ride will take place, or that any Member will be admitted at the border or avoid delays/secondary inspection. All outcomes vary.
8) Border Compliance & Risk Profiles
- Members are solely responsible for understanding and complying with all laws and regulations (e.g., CBP/CBSA, immigration, customs, traffic, insurance).
- Risk categories (e.g., NEXUS, Canadian/US Citizen or U.S. Green Card, U.S. Visa holder) are self-attested and may be inaccurate.
- I-94: For U.S. Visa holders, a valid I-94 may be required for entry. Without a valid I-94, secondary inspection and delays are likely; vehicle and personal belongings may be inspected. This can occur for any traveler at the discretion of authorities.
- BorderMatch does not provide legal, immigration, or compliance advice.
9) Use of the Service (On-Platform) & Off-Platform Interactions
On-platform scope. BorderMatch provides a matching function only: collecting self-reported preferences, and—after any applicable matching fee—exchanging contact details between interested Members. Our involvement ends at the moment contact details are released.
On-platform Member conduct. While using the Service, you agree to:
- Provide accurate, current, and complete information (including your stated border status).
- Share your contact details only when you intend to be contacted about cross-border travel.
- Refrain from creating fake requests/offers or otherwise manipulating matches.
Off-platform by design. After contact details are exchanged, all interactions occur off-platform and are solely between Members. BorderMatch does not monitor communications, arrange logistics, set prices, handle payments, provide transportation, or mediate disputes. You decide whether and how to communicate, whether to meet, and on what terms—at your own discretion and risk. If anything feels unsafe or unsuitable, do not proceed.
No monitoring, no control. BorderMatch does not supervise or control Members, their communications, or any subsequent arrangements. Our support is limited to account/content issues and on-platform functionality.
10) Prohibited Uses of the Service (On-Platform Only)
When using the BorderMatch platform (website/app), you agree not to:
- Misrepresent your identity, age, or border/immigration status, or create accounts on behalf of others without authorization.
- Post false, deceptive, or spam requests/offers; mass-message Members; or harvest/contact users for unrelated purposes.
- Share, sell, or publish other Members' contact details obtained through BorderMatch without their consent.
- Upload illegal, infringing, or abusive content, or use the Service to solicit or promote illegal activity.
- Scrape, crawl, reproduce, reverse engineer, or attempt to bypass access controls, security, or fees.
- Interfere with the Service's operation, including by introducing malware or performing denial-of-service actions.
BorderMatch may restrict or terminate access for violations of these on-platform rules. Reports of off-platform conduct may inform our on-platform enforcement, but BorderMatch does not monitor off-platform communications or arrangements.
11) Reviews, Content & License
You may submit text, images, or ratings ("Member Content"). You grant BorderMatch a worldwide, non-exclusive, royalty-free license to use, host, reproduce, and display Member Content to operate and improve the Service. You represent you have rights to your content and that it is lawful and non-infringing. We may moderate or remove content at our discretion.
12) Intellectual Property
The Service, software, and content (excluding Member Content) are owned by BorderMatch or its licensors and protected by law. You may not copy, modify, distribute, or create derivative works except as expressly permitted.
13) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." BORDERMATCH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MATCHES, RIDES, COMMUNICATIONS, PRICING, TIMING, OR OUTCOMES WILL OCCUR OR BE ERROR-FREE, SECURE, OR UNINTERRUPTED. BORDERMATCH DOES NOT CONTROL OR MONITOR MEMBERS, VEHICLES, DOCUMENTS, OR TRIPS AND IS NOT RESPONSIBLE FOR THEIR ACTS OR OMISSIONS.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BORDERMATCH, ITS AFFILIATES, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF DATA; PERSONAL INJURY; PROPERTY DAMAGE; OR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR ANY MATCH/RIDE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY—even if advised of the possibility.
Our aggregate liability for all claims shall not exceed the greater of (a) CAD $1 or (b) the total Matching Fees you paid to BorderMatch in the past 1 month.
Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.
15) Indemnification
You agree to defend, indemnify, and hold harmless BorderMatch and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your Member Content; (c) your interactions or agreements with other Members; (d) your violation of these Terms or law; or (e) your driving, travel, documents, or border compliance.
16) Suspension & Termination
We may suspend or terminate access, remove content, or refuse the Service at any time for any reason, including violations of these Terms or risk to others. You may delete your account at any time. Certain provisions survive termination (e.g., Sections 11–17).
17) Changes to the Service or Terms
We may modify the Service or these Terms at any time. Material changes will be posted with an updated "Effective date." Continued use after changes means you accept the new Terms.
18) Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of laws principles. You consent to the exclusive jurisdiction and venue of the courts located in Ontario for any dispute not subject to informal resolution. You and BorderMatch will first attempt to resolve disputes informally in good faith for 30 days before filing suit.

If any provision of these Terms is found unenforceable, the remainder stays in effect. Failure to enforce is not a waiver. These Terms constitute the entire agreement between you and BorderMatch regarding the Service.
